Abstract

Originality of a literary text is a key concept in various disciplines such as literary studies and copyright law. Each of these fields defines originality differently, depending on their respective goals and approaches to text analysis. This article explores how the interaction between these disciplines enables a deeper understanding of originality. In literary studies, originality is primarily seen as an aesthetic category reflecting the author’s unique creative style, innovative approach to themes, and forms. Key aspects of originality in this context include creative individuality, intertextuality, and stylistic uniqueness. Literary originality often involves a delicate balance between innovation and the integration of tradition. In copyright law, originality is a legal category determining whether a work is eligible for protection. The main criteria include the work being the result of independent creative effort, having a specific form of expression, and not being a direct reproduction of an existing work. Copyright law emphasizes the new elements of a text that distinguish it from others. The interdisciplinary approach to originality combines literary and legal perspectives, addressing issues such as intertextuality, the role of expert evaluations in plagiarism disputes, and the varying thresholds for novelty. Literary studies accept that originality can exist within tradition, while copyright law focuses on protecting new and distinct expressions. By synthesizing these approaches, the article highlights the cultural and legal significance of originality, offering a comprehensive understanding of how it is defined, assessed, and safeguarded in modern society.
